Terms of Service
Terms and conditions governing use of the Also Coder website and engagement of our development services.
These Terms of Service ("Terms") govern your use of the Also Coder website and your engagement with our web development, software, design and related IT services.
By accessing our website or entering into a project with us, you agree to these Terms.
1. About Also Coder
Also Coder provides custom software, web and mobile development, UI/UX design, automation and related digital services to businesses and individuals. We operate from India and serve clients domestically and internationally unless otherwise agreed.
2. Website use
You agree to use our website lawfully and not to:
- Attempt unauthorised access to our systems or data
- Upload malware, spam or harmful content through our forms
- Scrape, copy or republish site content for commercial use without permission
- Misrepresent your identity or affiliation when contacting us
We may suspend access if we believe these Terms are violated.
3. Enquiries and quotes
Information on our website — including pricing examples, timelines and package descriptions — is indicative only. A binding scope, price and timeline are confirmed only in a written proposal, statement of work (SOW) or invoice agreed by both parties.
We reserve the right to decline projects that are outside our expertise, unethical, illegal or misaligned with our capacity.
4. Projects and deliverables
When you engage us for paid work:
- Scope is defined in the agreed proposal or SOW. Work outside scope may require a change request and additional fees.
- Client responsibilities typically include timely feedback, content, assets, credentials and approvals. Delays on your side may shift timelines.
- Revisions are included as specified in your package or proposal. Extra rounds may be billed at our standard hourly or fixed revision rate.
- Third-party costs (domains, hosting, APIs, stock assets, app store fees, payment gateways) are usually billed separately unless explicitly included.
5. Intellectual property
Unless otherwise agreed in writing:
- Upon full payment, you receive ownership or a licence to use the final deliverables created specifically for your project (custom code, designs, content we produce for you).
- Pre-existing tools, frameworks, libraries and internal components we use remain our property or their respective licensors' property. We grant you a licence to use them as part of the delivered product.
- Portfolio rights — unless you request confidentiality in writing before project start, we may display non-sensitive project work (screenshots, descriptions) in our portfolio and marketing after launch.
Open-source components used in your project remain subject to their original licences.
6. Payment terms
- Invoices are due as stated on the invoice or proposal (commonly 50% advance and balance on milestones or delivery).
- Late payments may pause work and incur interest or reactivation fees as specified in your agreement.
- Taxes (including GST where applicable) are added as required by law.
See our Refund Policy for cancellation and refund rules.
7. Warranties and limitations
We warrant that services will be performed with reasonable skill and care consistent with industry standards for the agreed scope.
We do not guarantee:
- Specific business results (traffic, revenue, rankings, conversions)
- Uninterrupted or error-free operation of third-party platforms (hosting, app stores, payment providers)
- Compatibility with all future browser, OS or API changes beyond agreed support periods
To the maximum extent permitted by law, our total liability for any claim arising from a project is limited to the fees paid by you for that specific project in the twelve (12) months preceding the claim. We are not liable for indirect, consequential or lost-profit damages.
8. Support and maintenance
Post-launch support is included only if specified in your proposal. Ongoing maintenance, hosting management, security updates and feature additions may be offered under a separate support plan or on a time-and-materials basis.
9. Confidentiality
Both parties agree to keep confidential any non-public business, technical or financial information shared during the engagement, except where disclosure is required by law or the information is already public.
10. Termination
Either party may terminate a project according to the termination clause in the signed proposal. If no clause exists:
- You may cancel before work begins for a full refund of any unused advance (minus non-refundable third-party costs already incurred).
- After work has started, fees for completed milestones and work-in-progress apply. See the Refund Policy.
Upon termination, we deliver completed work and invoice for work performed to date.
11. Governing law
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Jharkhand, India, unless otherwise agreed in a signed contract.
12. Changes
We may update these Terms periodically. The updated version will be posted on this page with a revised date. Material changes to active projects will be communicated directly where required.
